Terminating Products

The Private Health Insurance (Complying Product) Amendment (Terminating Products) Rules 2018 (the Amendment Rules) were made on 14 September 2018 and registered on the Federal Register of Legislation on 17 September 2018.

These Amendment Rules give effect to new rule 9AA which sets out matters an insurer must address when writing to an insured adult policy holder to inform them about a product or product subgroup that will be terminated.

Rule 9AA implements consumer protections in cases where health insurance products are terminated and consumers are transferred to new policies. Previously there were no specific Rules to ensure consumers have the information needed to assist them in transferring to new policies when products are terminated by insurers.

The Amendment Rules will commence on the day after the Private Health Insurance Legislation Amendment Act 2018 receives the Royal Assent, which is expected to occur shortly.

The Amendment Rules and Explanatory Statement can be found by following the link to the Federal Register of Legislation.
